With the popularity of overseas vaping markets and the price differences between UK and non-UK products, many vapers wonder whether importing vaping products for personal use is legal. Here is a clear guide to the rules.
Importing vaping products into the UK is a nuanced legal area. For personal use, travellers returning from abroad or individuals ordering internationally can bring in limited quantities of vaping products, but those products may not meet UK TRPR standards even if they are legal in their country of origin. For commercial purposes, buying products to sell in the UK, full TRPR compliance, MHRA notification and HMRC import requirements apply. Selling non-TRPR-compliant products in the UK, even products legally purchased elsewhere, is a criminal offence under the regulations.
Individuals returning to the UK from EU or non-EU countries can bring personal quantities of vaping products for their own use. There is no specific duty-paid allowance for vaping products equivalent to the tobacco allowance, vaping products are subject to standard import duties. HMRC does not operate a specific customs duty-free allowance for e-liquids in the way it does for cigarettes and tobacco. Products imported for personal use that exceed what HMRC considers reasonable personal quantities can be seized or subject to duty assessment. The practical personal import situation is that small quantities for personal use are unlikely to attract HMRC attention, but there is no formal legal allowance.
A critical point that many vapers miss: even if you legally import vaping products into the UK, those products must still meet TRPR standards if they are to be used in the UK. A 30ml e-liquid bottle purchased legally in the US (where 60ml bottles are common) would be non-compliant with UK container size limits. A 50mg/ml nicotine salt from the US would be above the UK's 20mg/ml limit. Technically, possessing and using these products is not a criminal offence for personal users, but they have not been through the safety assessment that TRPR-compliant products have.
Any business importing vaping products into the UK with the intention of selling them commercially must ensure those products are fully TRPR-compliant, properly notified to the MHRA and imported in compliance with HMRC requirements. Selling non-compliant imported products is a criminal offence under TRPR regardless of their compliance status in the country of origin. HMRC also requires importers to pay the appropriate duties and VAT. Post-October 2026, the new vaping excise duty will also apply to commercial imports.
A significant portion of non-compliant vaping products in the UK market enters through informal or grey market routes, products ordered online from overseas suppliers that bypass the MHRA notification process and TRPR ingredient standards. These products represent a genuine consumer safety risk. They may contain banned compounds, exceed nicotine concentration limits and have not been through any safety assessment. Buying from registered UK retailers avoids this risk entirely.
Products sold by registered UK retailers operating under TRPR have been properly notified and meet UK safety standards. This is the simplest and most reliable way to ensure the products you use are compliant.
Price differentials between UK-compliant and imported products often reflect the cost of regulatory compliance, MHRA notification, ingredient standards, packaging requirements. Substantially cheaper imports may not have borne these costs because they have not met these standards.
